Sanitation Commissioner John Doherty gave the City Council a misleading scoop Wednesday when he said he planned to double the fine for pooper-scooper violations to $200.
A Doherty aide said the commissioner mistakenly cited the wrong figures. Though he does intend to double the fine in the fall, it will only rise from $50 to $100.
That's the limit of what he can do under the existing state law, the aide explained.
Doherty is determined to increase the fine to $250 by getting the state law amended, the aide added.
"Due to the importance of this issue, the department intends to pursue increasing the fine to $250 through a legislative amendment in the current state public health law when the state Legislature reconvenes next January," the Sanitation Department said in a statement.
